1. Ibn Hazam said:

ذهبت طائفة إلى أنه لا يجوز الصلاة إلا خلف الفاضل، وهو قول الخوارج والزيدية والروافض وجمهور المعتزلة وبعض أهل السنة. وقال آخرون إلا الجمعة والعيدين، وهو قول بعض أهل السنة. وذهب طائفة الصحابة كلهم دون خلاف من أحد منهم وجميع فقهاء التابعين كلهم دون خلاف من أحد منهم وأكثر من بعدهم وجمهور اصحاب الحديث وهو قول أحمد والشافعي وأبي حنيفة وداود وغيرهم إلى جواز الصلاة خلف الفاسق الجمعة وغيرها، وبهذا نقول. وخلاف هذا القول بدعة محدثة، فما تأخر قط أحد من الصحابة الذين أدركوا المختار بن عبيد والحجاج وعبيد الله بن زياد وحبيش بن دلجة وغيرهم عن الصلاة خلفهم ، وهؤلاء أفسق الفساق. وأما المختار فكان متهما في دينه مظنونا به الكفر.

A group said: There is no prayer behind anyone other than a virtuous. This is the saying of Khawarij, Zaidis, Rafidhis, Majority of Mutazilies and some people of sunnah. Others said all the prayers are valid behind a fasiq other than friday and eid prayers. This is the saying of some of ahlus sunnah.

While the madhab of all the sahaba who have no disagreement, all the tabiyeen who have no disagreement, majority of taba tabiyeen, majority of ashaab ul hadeeth and the saying of Ahmad, al Shafiee, Abu Hanifa, Dawud and others is that it is allowed to pray Jummah etc behind a sinner as well. This is what I (Ibn Hazam) also say. And saying against is an innovation.

Because The sahaba who met Mukhtar bin obaid, Hajjaj, Obaidullah bin Ziad.. and others, they (the sahaba) never left praying behind them. Even though these people were worse then fasiqeen and AS FOR MUKHTAR, HE WAS ACCUSED FOR HIS RELIGION AND SUSPECTED THAT HE WAS ON KUFR.

2. Imam al-Baghawi (may Allah have mercy on him) said:
” وأجاز الشافعي شهادة أهل البدع والصلاة خلفهم مع الكراهية ، على الإطلاق ، فهذا القول منه دليل على أنه إن أطلق على بعضهم اسم الكفر في موضع : أراد به كفراً دون كفر ، كما قال الله تعالى : ( ومن لم يحكم بما أنزل الله فأولئك هم الكافرون ) المائدة/ 44 ”

ash-Shaafa‘i regarded it as permissible to accept the testimony of innovators and to pray behind them, with no restrictions, even though he regarded that as disliked. This view of his indicates that if he describes some of them as kaafirs on any occasion, what he meant was lesser kufr, as in the verse in which Allah, may He be exalted, says (interpretation of the meaning): “And whosoever does not judge by what Allah has revealed, such are the Kafiroon (i.e. disbelievers – of a lesser degree as they do not act on Allah’s Laws)” [al-Maa’idah 5:44].
