Assalamualaikum Wa Rahmatullahi Wa Barkatahu (May Peace, Blessings & Mercy of Allah Be Upon You)

Article by Sister Noor-ul-Huda & Brother Asim ul Haq

The Article is in reply to these series of allegations:

1) Refutation Series I: Muslim Women are Dirty Polluting Creatures
2) Refutation Series II:Women are inferior, slave to men
3) Refutation Series III: Muslim women are sex object for men enjoyment
4) Refutation Series IV: Muslim Men can Capture Infidel Women as Sex Slave

5) Refutation Series V: A Woman’s Testimony is Worth Only Half of a Man’s
6) Refutation Series VI: Brutal Punishment For Women
7)Refutation Series VII: Fewer seats for women in Allah’s Paradise
8) Refutation Series VIII: The Tyranny of Men over Women

9) Refutation Series IX: Polygamy
10)Refutation Series X: Wife Swapping

Allegation number 11: Muslim women are sex object for men’s enjoyment

The allegation is that women are objects of enjoyment whereas this is what Islam is against and hence the hijab for women. The article below shows the freedom the women in islam enjoy to the extent that they can reject a proposal.

Answering Islam quoted
Baby Tilths

Sura (65.4) You can marry (and divorce) little girls who have not yet reached menstruation age. This is Allah teaching of pedophilia allowing Muslim men to rape young Muslim baby girls.

“And those of your women as have passed the age of monthly courses, for them the ‘Iddah (prescribed period), if you have doubts (about their periods), is three months, and for those who have no courses [(i.e. they are still immature) their ‘Iddah (prescribed period) is three months likewise, except in case of death] . And for those who are pregnant (whether they are divorced or their husbands are dead), their ‘Iddah (prescribed period) is until they deliver (their burdens), and whosoever fears Allah and keeps his duty to Him, He will make his matter easy for him.”

Following is a famous fatwa by Ayatollah Khomeini that defines sura 65.4

“A man can marry a girl younger than nine years of age, even if the girl is still a baby being breastfed. A man, however is prohibited from having intercourse with a girl younger than nine, other sexual acts such as foreplay, rubbing, kissing and sodomy is allowed. A man having intercourse with a girl younger than nine years of age has not committed a crime, but only an infraction, if the girl is not permanently damaged. If the girl, however, is permanently damaged, the man must provide for her all her life. But this girl will not count as one of the man’s four permanent wives. He also is not permitted to marry the girl’s sister.”

Response

In the verse the author mentioned, I tried to find the word RAPE or provision of RAPING muslim BABY GIRLS (as per the author’s perception), but I couldn’t find anything of the sort.

Why are these people creating issues based on ASSUMPTIONS of their fickle minds like the one by the author: “This is Allah teaching of pedophilia allowing Muslim men to rape young Muslim baby girls.”

To support his argument, he needs valid points and not mere assumptions of his own. The author, in his article, is unable to justify his allegations because he is a confused person who puts verses of the Qur’an which are actually praising women and are strictly ordering to protect and respect women.

Like the verse author mentioned has the ruling regarding the age of MARRIGE and what to do if the marriage is need to be ended in a legal way, of course.

[004:006] And try orphans (as regards their intelligence) until they reach the age of marriage; if then you find sound judgment in them, release their property to them, but consume it not wastefully, and hastily fearing that they should grow up, and whoever amongst guardians is rich, he should take no wages, but if he is poor, let him have for himself what is just and reasonable (according to his work). And when you release their property to them, take witness in their presence; and Allah is All Sufficient in taking account.

One can marry when he or she reach the age of marriage and this is complete marriage but if someone marries before the age of puberty that does not imply that it is permissible to have intercourse with her, because it is not complete marriage as it is proven that the Prophet (peace and blessings of Allaah be upon him) delayed consummating the marriage to ‘Aa’ishah (may Allaah be pleased with her). And after that when she is able to decide about her marraige she can even reject her husband if she doesn’t like him as we will quotee ahadeeth in this article Insha`Allah:

There is another opinion that Shaykh Shabbir Ahmad Translated 65:4 “And such of your women as no longer expect menstruation, as well as those women who do not have menstruation (for any physiological reason), to resolve your doubts, their waiting period is ordained to be three months. And for those who are pregnant, the waiting period ends when they deliver their burden. And anyone who is mindful of Allah, He will make his situation easy for him.”http://islamawakened.org/quran/65/4/default.htm

It is mentioned in Ahsan al Byan under the verse 65:4″It is regarding those Women who are very old. or for Those Who do not have Menses” it is clear that they could not menstruate

Imam an-Nawawi said

، وقال مالك والشافعي وأبو حنيفة : حدُّ ذلك أن تطيق الجماع ، ويختلف ذلك باختلافهن ، ولا يضبط بسنٍّ ، وهذا هو الصحيح ،
Maalik, al-Shaafa’i and Abu Haneefah said: the marriage may be consummated when the girl is able for intercourse, which varies from one girl to another, so no age limit can be set. This is the correct view.[Sharh Muslim, 9/206]

He also said

It should be noted that al-Shaafa’i and his companions said: It is preferable for fathers and grandfathers not to marry off a virgin until she reaches the age of puberty and they ask her permission, lest she end up in a marriage that she dislikes. What they said does not go against the hadeeth of ‘Aa’ishah, because what they meant is that they should not marry her off before she reaches puberty if there is no obvious interest to be served that they fear will be missed out on if they delay it, as in the hadeeth of ‘Aa’ishah. In that case it is preferable to go ahead with the marriage because the father is enjoined to take care of his child’s interests and not to let a good opportunity slip away.[Sharh Muslim, 9/206.]

If a woman does not like her Husband she can leave him or if the marriage is against her will she can leave her husband.

Proof 1: Narrated Al-Qasim: A woman from the offspring of Ja’far was afraid lest her guardian marry her (to somebody) against her will. So she sent for two elderly men from the Ansar, ‘AbdurRahman and Mujammi’, the two sons of Jariya, and they said to her, “Don’t be afraid, for Khansa’ bint Khidam was given by her father in marriage against her will, then the Prophet cancelled that marriage.” (Bukhari Book #86, Hadith #99)

Proof 2: Narrated Abdullah ibn Abbas: A virgin came to the Prophet (peace_be_upon_him) and mentioned that her father had married her against her will, so the Prophet (peace_be_upon_him) allowed her to exercise her choice. (Abu Dawud Book #11, Hadith #2091)

So she is not bound with her husband that she have to go with him after she reach the age of marriage, By the way Ayathullah Khomeni is not evidence.
