After the commendable articles of Haafidh Zubayr Ali Za’ee and Haafidh Muhammad Siddeeq Raza on this issue, here we shall mention some additional points & references.
I) Muhadditheen were not Muqallid Part 2
According to some people, Imaam Abu Bakr Ahmed bin Husayn al-Bayhaqi rahimahullah is famous for being a Shaafi’ee “Muqallid” while the reality is contrary to this. The respected Imaam once explicitly said about himself while commenting on a hadeeth that:
"ولا أقوله تقليدا بل أقوله بالحجج التي ظهرت لي، منها.... إلخ"
“And I am not saying this doing Taqleed, rather I am saying it based on the evidences that have appeared to me, among them… and so on” [Juzz al-Juwaybaari fi Masaail Abdullah bin Salaam by al-Bayhaqi, published in Majmoo’ah Ajzaa Hadeethiyyah (2/235)]
Imaam Bayhaqi rahimahullah has himself negated from being a Muqallid – as (he implied) I take the evidences under consideration, and have no relation with taqleed. This saying of Imaam Bayhaqi also indicates that Taqleed & Dalaail (evidences) are opposites of each other. Once a Daleel arrives, Taqleed disappears; If Taqleed is there then there is no existence of Dalaail. Perhaps this is why the “Imaam” of Deobandiyah, Sarfaraz Khan Safdar wrote: “And Taqleed is only for a Jaahil” [Al-Kalaam al-Mufeed P. 234]
2- Imaam Tirmidhi rahimahullah
Imaam Tirmidhi rahimahullah is also counted among the Muqallideen of Imaam Shaafi’ee rahimahullah, while the reality is totally opposite. The “Hakeem” of Deobandi Ummah, Ashraf Ali Thaanvi said:
"قلت يدل علي أن الترمذي ليس بشافعي"
“I say: it proves that Al-Tirmidhi was not a Shaafi’ee” [Ath-Thawaab al-Huliyy Tatimmah al-Misk az-Zaki (P. 543)]
These benefits of Thaanvi are published in Urdu at the end of “Taqreer-e-Tirmidhi”. While further commenting on this saying, the student of Thaanvi, Ahmed Hasan Sanbhuli wrote:
“I say: It is evident that the erudite Muhadditheen did not do Taqleed of anyone, except that their action would resemble some A’immah in some issues, whom they are attributed to or (said to) do Taqleed of. The gist is that whenever they find the saying of a Muqallad (the one whose Taqleed is done) going against the Hadeeth, then they oppose those A’immah; and this is the way of the people of Tahqeeq of this Ummah”

The “Aalim Rabbaani” of Deobandi Sect, Abdul Qaadir explains the saying of Thaanvi under its footnote saying:
“Imaam Tirmidhi has objected on the saying of Imaam Shaafi’ee on the issue of delaying Zuhr until it cools off; this proves that he was not Shaafi’ee ul-Maslak” [Ibid]
Benefit: Not only this reference proves that Imaam Tirmidhi was not a Muqallid, it also proves that according to the Akaabir Deobandis, a Muqallid is one who does not object to his Imaam’s saying; otherwise he will not remain a Muqallid. Bismillah Alhamdulillah, All praise is due to Allaah. Muqallideen use many different tactics to prove their unproven Taqleed. They concoct many things to satisfy the people, one of which includes that the writers and collectors of the books of ahadeeth were Muqallid. The people who have extended tongues say many other things too, but right now, our discussion is restricted to the Muhadditheen.
1- Ameen Okaarvi from the Deobandi School of thought titled “Wakeel-e-Ahnaaf (The Lawyer of Ahnaaf), Tarjumaan ul-Islaam (Representative of Islam), Munaazir-e-Islaam (Debater of Islam)” and has been given many other titles (by deobandis only), writes:
“Whereas, all the books of ahadeeth that we have today, are either written by Mujtahideen or by Muqallideen, who are mentioned in Tabaqaat Hanafiyyah, Tabaqaat Maalikiyyah, Tabaqaat Shaafi’eeyyah, and Tabaqaat Hanaabilah…. There does not exist a single reliable book of hadeeth in which believing in Ijmaa and Ijtihaad is considered to be Haraam & Shirk; or believing in Fiqh has been prohibited. Not even one reliable reference can be presented concerning its compiler that he was neither able to do Ijtihaad nor did he do Taqleed, that’s why he was a Ghayr Muqallid.”[Tajalliyaat Safdar: 1/113; Published in Multan, Majmoo’ah Rasaail: 3/13]
Was Imam Muslim a Muqallid as Modern muqallideen claim? No, Imam Muslim was not a Muqallid and he did not do taqleed. A tremendous article by Shaikh Siddique Raza (Hafizahullah) in urdu entitled "Kya Muhadditheen muqallid thay?" i.e Were the Muhadditheen muqallid? from the monthly magazine of Shaikh Zubair Ali Zai "Al Hadeeth" 77. Islam is Not just a religion but is a complete system of life for a mankind to live. Islam orders us all that is good and moral and prohibits all that is evil from it. It orders all actions which are righteous and good and prohibits all actions that are evil and harmful.(Quran 16:90).
► Islam provides mankind with a higher system of morality that can be used by an individual to realize his greatest potential.
► Islam purifies the soul of self-seeking egotism, tyranny, wantonness, and lack of discipline.
► It creates God-fearing men who are devoted to their ideals, motivated by piety, abstinence, and discipline, and unable to make any compromise with falsehood.
► It induces feelings of moral responsibility and fosters the capacity for self-control.
► Islam generates kindness, generosity, mercy, sympathy, peace, disinterested goodwill, scrupulous fairness, and truthfulness towards all creation in all situations.
► It nourishes noble qualities from which only good may be expected.
The first thing that one should know and clearly understand about Islam is what the word "Islam" itself means. The religion of Islam is not named after a person as in the case of Christianity which was named after Jesus Christ, Buddhism after Gotama Buddha, Confucianism after Confucius, and Marxism after Karl Marx. Nor was it named after a tribe like Judaism after the tribe of Judah and Hinduism after the Hindus. Islam is the true religion of "Allah" and as such, its name represents the central principle of Allah's "God's" religion; the total submission to the will of Allah "God". The Arabic word "Islam" means the submission or surrender of one's will to the only true god worthy of worship "Allah" and anyone who does so is termed a "Muslim", The word also implies "peace" which is the natural consequence of total submission to the will of Allah. Hence, it was not a new religion brought by Prophet Muhammad (PBUH) I in Arabia in the seventh century, but only the true religion of Allah re-expressed in its final form.
Islam is the religion which was given to Adam(pbuh), the first man and the first prophet of Allah, and it was the religion of all the prophets sent by Allah to mankind. The name of God's religion lslam was not decided upon by later generations of man. It was chosen by Allah Himself and clearly mentioned in His final revelation to man. In the final book of divine revelation, the Qur'aan, Allah states the following:
"This day have I perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion". (Quran 5:3)
"If anyone desires a religion other than Islam (submission to Allah (God) never will It be accepted of Him" (Quran 3:85)
Just like for a man made electronic gadget we refer to the user's manual to know how it works or for any troubleshootings or FAQs similarly the creator of all mankind Allah has given us Islam as a complete system of life for all the various aspects of our daily life. which includes eating, worshiping, sleeping, relieving oneself, dress, marriage, . In short, Islam has provided guidelines and rules for every sphere of life and society. Some of the examples which makes Islam 'The Only Complete System of Life' to live are:
► Zakat & Sadaqah, cure for Poverty: If you want a cure of poverty, then analyze the islamic system of zakathh and sadaqah. when the muslims applied zaakah in the early days they were not able to find a single poor person
► Oppression: Similarly if u want a cure for oppression, Allah says: o my servants, i have made oppression forbidden upon myself and have made it prohibited between you so oppress not one another.
► Cure for Sexual Diseases and Adultery or Fornication: and do not approach unlawful sexual intercourse indeed, it is ever an immorality and is evil as a way (Quran 17:32), and prophet(pbuh) advised young men who are able to afford it to hasten and get married inorder to close door for forbidden relations and from having boyfriends or girlfriends.
► Cure for Intoxication(Alcohol) and Drugs: Allah says in the Quran: O you who have believed, indeed intoxicants, gambling, stone altars and divining arros are but defilement from work of satan so avoid it that you may be successful (Quran 5:90)
► Other Relatives: And render to the relatives their due rights, as (also) to those in need, and to the traveler; and do not squander your wealth in the manner of a spendthrift. (Quran 7:26)
The Prophet said: "He is not a believer who eats his fill when his neighbor beside him is hungry" and "He does not believe whose neighbors are not safe from his injurious conduct."
►Orphans: The Prophet (saws) said, I and the person who looks after an orphan and provides for him, will be in Paradise like this," putting his index and middle fingers together (Sahih Al-Bukhari Hadith 8.34 Narrated bySahl bin Sad, Al-Tirmidhi Hadith 4974 Narrated by Abu Umamah).
Allah's Messenger (saws) said, The best house among the Muslims is one which contains an orphan who is well treated, and the worst house among the Muslims is one which contains an orphan who is badly treated (Al-Tirmidhi Hadith 4973 Narrated by Abu Hurayrah)
Those who have responded to this call and gathered together into a community (Ummah) are given the name "Muslim" and the singular object underlying the formation of this community (Ummah) is that it should make an organized effort to establish and enforce goodness and suppress and eradicate evil. The Qur'an is quite explicit on this fact as can be seen from the following verses:
"Ye are the best for Peoples, evolved For mankind, Enjoining what is right, Forbidding what is wrong, And believing in God. If only the People of the Book Had faith, it were best For them: among them Are some who have faith, But most of them Are perverted transgressors." (Qur'an, 3:1 10)
"(They are) those who, If we establish them In the land, establish Regular prayer and give Regular charity, enjoin The right and forbid wrong: With God rests the end (And decision) of (all) affairs." (Qur'an, 22:41)
